The Legalities of Fax BroadcastingEven though fax broadcasting is a great marketing tool, this does not mean that a company has free reign to send unsolicited faxes out into the world with no regard for the recipients. Within the United States of America, prior to July of 2005 it was illegal for companies to send fax broadcasting advertisements to recipients who did not specifically request to receive the fax. However, eventually the Federal government did allow the sending of fax broadcasting regarding unsolicited materials with no interference from the federal government itself. Despite this seeming win for companies looking for new consumers, there were a number of stipulations put on the use of fax broadcasting. Now, it is required that all companies that send out unsolicited fax broadcasting advertisements put clearly and plainly on the fax how the individual or business can be removed from the fax broadcasting recipient list. In addition, it must be free for the individual or company to be removed from the distributor’s fax broadcasting list. Even so, there are still some areas in which there are laws that have been previously put in effect by the state which may work to override this federal ruling. As a result, it is extremely important for the companies that use fax broadcasting as a means of unsolicited advertisement to investigate the specific laws in their area. Despite the fact that Federal law mandates that fax broadcasting of all types is legal, there are still some areas in which a person can be prosecuted for sending out unsolicited fax advertisements.
