Small Claims Court


Even if you are a law-abiding citizen, you may at one time or another find yourself in small claims court. The type of court is used to hear small disputes between people when the damages are low. When you go to small claims court, you represent yourself, though you can get advice from a lawyer. In most cases, the cases heard in small claims court are disputes between neighbors, those involved in fender benders, disgruntled clients, and family disputes. If you’ve ever watched a court show in television, you probably know that money and family does not mix.

When you can’t agree, it is probably best to take your dispute to a small claims court. This way, the matter is settled in the eyes of the law, and is done in as fair a manner as possible. All rulings are final, and most parties end up accepting the final judgment, whether they like it or not. If you want to take someone to court, or have received a summons, you have to do your best to prepare yourself.

One way to prepare is to make sure you have all of the documents you need. This means gather receipts, bank records, and other items that will help you prove your case. Before you gather these items however, do some research on what is acceptable and what is not. So many people come in with stuff that is just not going to help them, and this ends up frustrating everyone.

Watching television shows about small claims court can teach you a lot about how to handle your daily affairs. The main lesson to learn is to get everything in writing, and keep all of your receipts. It might seem strange to you to write up a contract when your brother wants to borrow a thousand dollars to get his car fixed, but if you don’t have it in writing, it will end up being his word against yours if you end up in small claims court over the matter. Money does strange things to people, so getting something in writing is always in your best interest.

You may also want to look up local ordinances and laws if you are in a dispute with a neighbor. This little step can make or break your case. If they insist your tree fell and destroyed their car, having knowledge of your local laws will help you prove your case. On the other hand, if you find out your neighbor is right, you can then settle before you go, and avoid small claims court altogether.
