Filing Bankruptcy


In the times that we live in, material goods and wealth seem to be some of the most important things to cherish. As people compete against each other to look good and live well, there will be some people that lose the race and never recover. In some severe cases, people might even have to file for bankruptcy. This process can carry with it many negative feelings like guilt and shame. Nobody wants to admit defeat, and that’s how most people would describe bankruptcy.

People should understand that the federal government has made the act of filing bankruptcy possible in order for families to recover. One misnomer that people think about when they consider bankruptcy is that only the poor people, those who don’t want work, or those that are too lazy to help themselves file for bankruptcy. This is not true. Some people who have plenty of money can go bankrupt just as quickly as anyone else. It is simply a matter of how money is managed and not how much of it you have. In some cases, it is the last resort of those who have experienced a sudden job loss or a major medical issue that they had no control over.

Creditors and Bankruptcy

There are a lot of stories that circulate about this situation, and most of them are untrue. Some of these tales are started by creditors who don’t want to lose money on the people who have filed for bankruptcy. Once you file and begin this process, the creditors are legally forbidden to contact you for collection purposes. Some will still try to call, and they may even make demands or threats in the hope of intimidating you into handing over money that you do not have. If this happens, you can contact the attorney handling the case, and he will remind the collection agency of the laws surrounding this process.

When businesses file for bankruptcy, the same basic plan is followed. People and businesses don’t file for bankruptcy protection because it’s fun or easy. There is a real need for help, and the need is often accompanied by feelings of guilt and frustration in being unable to fulfill obligations. Some people can become so depressed by filing that they need counseling just to recover from the difficult process. Bankruptcy is always going to be around as long as people live in a free market economy. Fortunately, there are ways to get out of this challenging situation, and find your way back on the road to financial health.
